01 Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you and Playfull GAMES LLC ("Playfull Rewardz," "we," "us," or "our") and govern your access to and use of the website at getplayfullrewardz.app (the "Site") and your participation in the Playfull Rewardz games and quizzes community (the "Community," together with the Site and games, the "Services"). By accessing the Site, creating an account, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

02 Definitions

• "Member" means an individual who has created an account with the Community.
• "Game" or "quiz" means an interactive entertainment activity made available through the Services.
• "Score" means a result, point total, ranking, or streak recorded for a Game.
• "Reward" or "incentive" means any optional reward that may be offered in connection with a particular activity, where applicable.
• "Content" means text, graphics, logos, designs, games, questions, and other materials made available through the Services.

03 Eligibility

To create an account and use the Services, you must:

• Be at least 18 years of age and able to form a legally binding contract;
• Provide accurate, current, and complete information during registration;
• Have a valid email address;
• Not be barred from using the Services under applicable law; and
• Agree to these Terms and our Privacy Policy.

We may decline any registration or remove any Member who does not meet these requirements, at our discretion.

04 Nature of the Services

Participation in the Community is entirely voluntary. There is no obligation to play any game or complete any quiz. Membership does not constitute employment, a job, a partnership, a contract for services, a franchise, or any other business relationship between you and Playfull Rewardz, and nothing in these Terms should be read as a promise of income, earnings, or work.

The availability of any particular game, quiz, or feature is not guaranteed and may vary or change over time. We make no representation that any specific activity will be available to you at any time.

05 Entertainment Only · No Gambling

The Services are provided for entertainment purposes only. Our games and quizzes are activities of skill and amusement. They are not gambling, betting, wagering, lotteries, or games of chance, and no purchase, payment, deposit, stake, or other consideration is ever required to play or to be eligible for any reward we may choose to offer.

06 Account Registration & Security

You are responsible for maintaining the confidentiality of your account information and for all activity that occurs under your account. You agree to provide accurate information, keep it up to date, and notify us promptly of any unauthorised use. You may hold only one account unless we expressly permit otherwise.

07 No Purchase Necessary

No purchase is ever required to create an account or to play. You will never be asked to pay any fee to join, to maintain membership, or to access a game or quiz. We will never ask you to make a payment in order to receive a reward.

08 Acceptable Use & Prohibited Conduct

As a condition of using the Services, you agree that you will not:

• Provide false, misleading, or fraudulent information, or impersonate any person;
• Maintain more than one account, or register on behalf of another person without authorisation;
• Cheat, manipulate scores, exploit bugs, or otherwise interfere with fair play;
• Use bots, scripts, automated tools, or other means to interact with the Services or inflate scores;
• Copy, share, sell, or republish games, quiz questions, or other Content without permission;
• Interfere with, disrupt, or attempt to gain unauthorised access to the Services or related systems;
• Upload or transmit malicious code, or engage in any activity that is unlawful, abusive, or harmful to others;
• Infringe the intellectual-property or privacy rights of any person; or
• Use the Services in violation of any applicable law or regulation.

Violation of this section may result in suspension or termination and forfeiture of any associated reward.

09 Gameplay & Fair Play

When you play, you agree to do so honestly and fairly. Games and quizzes may include time limits, scoring rules, attention checks, and anti-fraud controls. Scores or results that are produced through cheating, automation, exploitation of errors, or other unfair means may be rejected or reset, and may result in forfeiture of any associated reward. We may modify, suspend, or remove any game, quiz, scoring system, or leaderboard at any time.

10 Rewards & Incentives

Some activities may offer an optional reward for participation, and many may not. Where a reward is offered, its specific nature, amount, form, eligibility, and conditions will be clearly stated at the time and will be subject to the terms set out there. Rewards:

• are not guaranteed for any activity or any Member;
• vary by activity and may change or be discontinued at any time;
• have no cash value except as expressly stated in the relevant offer;
• may be withheld or reversed for activity that is fraudulent, automated, duplicated, or otherwise in breach of these Terms.

You are solely responsible for any taxes that may apply to any reward you receive. Playfull Rewardz does not provide tax advice. Participation is for entertainment and is not a source of employment income, and rewards are not wages or a salary. We make no promise of income, winnings, or financial gain of any kind.

11 Intellectual Property

All Content on the Site — including text, graphics, logos, designs, games, and quiz questions — is owned by or licensed to Playfull GAMES LLC and is protected by intellectual-property laws. Except as expressly permitted, you may not reproduce, distribute, modify, or create derivative works from any Content without our prior written permission.

12 User Feedback & Content

You may choose to submit feedback, ratings, reviews, or comments about games and quizzes ("User Content"). You retain ownership of your User Content, but you grant Playfull Rewardz a worldwide, non-exclusive, royalty-free, sublicensable licence to use, reproduce, analyse, display, and report on that User Content to operate and improve the Services, including in anonymised or aggregated form. You are responsible for your User Content and represent that it does not infringe any third-party right or violate any law. We may remove User Content that breaches these Terms.

13 Third-Party Services & Links

The Services may link to or rely on third-party websites and services, including games or content hosted by partners. We do not control and are not responsible for the content, policies, or practices of third parties. Your use of any third-party service is governed by that third party's own terms and policies.

14 Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and share personal information. By using the Services, you acknowledge the practices described there.

15 Electronic Communications & Notices

By creating an account, you consent to receive communications from us electronically, including emails about your account and featured activities. You may unsubscribe from non-essential emails at any time using the link in those messages or by contacting us; certain service or transactional messages may still be sent while your account is active. You agree that electronic notices satisfy any legal requirement that communications be in writing.

16 Termination & Suspension

You may close your account at any time by contacting support@getplayfullrewardz.app. We may suspend or terminate your account or access to the Services at any time, with or without notice, if we believe you have violated these Terms, provided fraudulent information, or engaged in abusive or unlawful behaviour, or for any other lawful reason. Upon termination, your right to use the Services ends. Sections that by their nature should survive termination (including Sections 10–12 and 17–23) will survive.

17 Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

18 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PLAYFULL GAMES LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT OF REWARDS YOU RECEIVED FROM US IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

19 Indemnification

You agree to indemnify, defend, and hold harmless Playfull GAMES LLC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Services, your User Content, your violation of these Terms, or your violation of any law or third-party right.

20 Dispute Resolution & Arbitration

Informal resolution first. Before filing any formal claim, you agree to contact us at support@getplayfullrewardz.app and attempt to resolve the dispute informally for at least 30 days.

Binding arbitration. If we cannot resolve a dispute informally, you and Playfull Rewardz agree that any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by [Arbitration Provider] under its applicable rules, rather than in court, except that either party may bring qualifying claims in small-claims court.

Class-action waiver. To the extent permitted by law, disputes will be conducted only on an individual basis and not as a class, collective, or representative action.

Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@getplayfullrewardz.app with your name and a statement that you wish to opt out.

21 Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. Subject to Section 20, the state and federal courts located in Harris County, Texas will have exclusive jurisdiction over any disputes not subject to arbitration, and you consent to that jurisdiction and venue.

22 Changes to These Terms

We may revise these Terms from time to time. We will post the updated Terms on this page with a revised "Last updated" date and, where required, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Services.

23 General Provisions

Severability

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

Waiver

Our failure to enforce any provision is not a waiver of our right to do so later.

Force majeure

We are not liable for any delay or failure to perform due to causes beyond our reasonable control.

Entire agreement

These Terms and our Privacy Policy constitute the entire agreement between you and us regarding the Services and supersede any prior agreements.
